Study on the Data Portability of EU GDPR and Its Reference for China

Abstract:

The EU General Data Protection Regulation(GDPR) have been in force since May 2018, which is of pioneering significance for enhancing the rights of data subjects and promoting free competition and development in the EU. Data portability is a new type of right introduced by the GDPR. It evolved from the long-term legislative norms of the European Union, with copy access rights and copy transfer rights as the core contents.Data portability can strengthen the data subject rights and promote industry data transmission format standard, but it can also damage valuable proprietary information and intellectual property, create privacy and data security risks, and increase corporate compliance costs. China is in the high-speed period of information technology development, and more attention is paid to data protection. Whether China should introduce data portability and how to learn from it are the focuses of this paper.
