Abstract:

By analyzing the main legal norms involved in the Australian telecommunication data retention and access system, and combining with the combing of related events and literature, we can conclude that the Australian telecommunication data retention and access system is based on the assumption that the telecommunication data collection is less entitled to intervene than secretly obtaining the telecommunication content. And there are some problems, such as the range of retained telecommunication data and the main body of accessing telecommunication data are uncertain, the setting of retention period is unreasonable, and the control of the telecommunication data access right is insufficient. We should draw lessons from the experience and lessons of the Australian telecommunication data retention and access system, and pay more attention to the righttointerference of the retention and access of telecommunication data. In addition，we should update the legal norms of telecommunication data retention and access, and improve the retention and access system of telecommunication data.
